CONSUMER RIGHTS – RIGHT OF WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS
GENERAL:
If you place an order electronically via the www.icashop.com.tr website, you are deemed to have accepted the pre-information form and the distance sales agreement presented to you.
This is subject to the provisions of the Law and the Regulation on Distance Contracts (OG: 27.11.2014/29188) and other current legislation.
Unless otherwise stated, shipping costs, which are the expense of Product shipment, shall be paid by the buyers.
Each purchased product shall be delivered to the person and/or organization at the address indicated by the buyer, provided that the legal period of 30 days is not exceeded. If the product is not delivered within this period, the Buyer may terminate the contract.
The purchased product must be delivered complete, in compliance with the qualifications specified in the order, and with documents such as a warranty certificate and user manual, if any.
If the sale of the purchased product becomes impossible, the seller is obliged to notify the buyer of this situation in writing within 3 days from the date they become aware of the situation. The total amount must also be refunded to the Buyer within 14 days.
IF THE PURCHASED PRODUCT PRICE IS NOT PAID:
If the Buyer fails to pay the price of the purchased product or cancels it in the bank records, the Seller's obligation to deliver the product ceases.
PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:
If, after the product is delivered, it is determined that the credit card used for payment by the buyer was used unfairly by unauthorized persons, and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the contract to the SELLER within 3 days, with the shipping cost borne by the SELLER.
IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:
If force majeure events occur which the Seller cannot foresee, and the product cannot be delivered on time, the situation shall be notified to the Buyer. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, the fee shall be refunded in cash within 14 days of cancellation. If the Buyer made the payment by credit card and cancels, the product price shall be refunded to the bank within 14 days of this cancellation, but it is likely that the bank will transfer it to the buyer's account within 2-3 weeks.
BUYER'S OBLIGATION TO INSPECT THE PRODUCT:
The Buyer shall inspect the contracted goods/services before receiving them; they shall not accept damaged or defective goods/services such as crushed, broken, torn packaging, etc., from the courier company. The received goods/services shall be deemed undamaged and intact. The BUYER must protect the goods/services diligently after delivery. If the right of withdrawal is to be exercised, the goods/services must not be used. The Invoice must also be returned with the product.
RIGHT OF WITHDRAWAL:
The BUYER may exercise the right to withdraw from the contract by rejecting the goods without undertaking any legal or criminal liability and without giving any reason, provided that they notify the SELLER via the communication information below within 14 (fourteen) days from the date of delivery of the purchased product to themself or the person/organization at the address indicated.

PERIOD FOR RIGHT OF WITHDRAWAL:
If the product purchased by the Buyer is a service, this 14-day period starts from the date of the contract signing. The right of withdrawal cannot be exercised in service contracts where the performance of the service has started with the consumer's consent before the withdrawal period expires.
The expenses arising from the use of the right of withdrawal belong to the SELLER.
To exercise the right of withdrawal, a written notification must be made to the SELLER via registered mail, fax, or email within the 14 (fourteen) day period, and the product must not have been used within the framework of the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions regulated in this contract.
EXERCISING THE RIGHT OF WITHDRAWAL:
The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent together with the return invoice issued by the corporation. Order returns issued in the name of corporations cannot be completed unless a RETURN INVOICE is issued.)
The return form, the box, packaging, and standard accessories (if any) of the products to be returned must be delivered completely and undamaged.
RETURN CONDITIONS:
The SELLER is obliged to refund the total amount and the documents that put the BUYER under debt within a maximum period of 10 days from the date of receipt of the withdrawal notification and to take back the goods within a 20-day period.
If there is a decrease in the value of the goods due to a fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's losses in proportion to their fault. However, the BUYER is not responsible for changes and deteriorations that occur due to the proper use of the goods or product within the right of withdrawal period.
If the campaign limit amount organized by the SELLER is dropped below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign is canceled.
PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:
Goods prepared in line with the BUYER's requests or explicit personal needs and which are not suitable for return, lower parts of underwear, swimwear and bikini bottoms, make-up materials, disposable products, goods that are in danger of spoiling quickly or likely to expire, products whose return is unsuitable for health and hygiene reasons if their packaging is opened by the BUYER after delivery, products that mix with other products after delivery and cannot be separated due to their nature, goods relating to periodicals such as newspapers and magazines, except those provided under the subscription contract, services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer, and the return of audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables is not possible according to the Regulation if their packaging is opened by the BUYER. Furthermore, the use of the right of withdrawal regarding services whose performance has begun with the consumer's consent before the expiry of the right of withdrawal period is also not possible according to the Regulation.
Cosmetics and personal care products, underwear products, swimwear, bikini, books, copyable software and programs, DVD, VCD, CD and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) must be unopened, untested, undamaged, and unused to be eligible for return.
DEFAULT AND LEGAL CONSEQUENCES
Should the BUYER default on payment transactions made with a credit card, the BUYER accepts, declares, and undertakes that they will pay interest and be responsible to the bank within the framework of the credit card agreement between them and the cardholder bank. In this case, the relevant bank may resort to legal remedies; it may claim the resulting expenses and attorney's fees from the BUYER, and under all circumstances, if the BUYER defaults due to their debt, the BUYER accepts to pay the loss and damage incurred by the SELLER due to the delayed performance of the debt.
